An Act to amend the Criminal Code (restitution orders)
Bill C-238 in 45-1 was a Conservative Private Member's Bill amending the Criminal Code (R.S.C. 1985, c. C-46) sections 738-741 to expand mandatory restitution orders in criminal sentencing. Currently restitution under sections 738-741 is at judicial discretion; the bill would have made restitution mandatory for property-loss-related offences (theft, fraud, robbery) where the loss amount is quantifiable. Brought as the Canadian Anti-Fraud Centre received approximately 113,000 fraud reports in 2023 totaling $568 million in reported losses, with victim-restitution recovery rates below 20 percent. Companion to the 2015 Canadian Victims Bill of Rights (S.C. 2015, c. 13, s. 2). Did not pass second reading.
