An Act to amend the Criminal Code, to make consequential amendments to other Acts and to repeal a regulation (miscarriage of justice reviews)
An Act respecting Miscarriage of Justice Review Commission (David and Joyce Milgaard's Law). Royal assent June 20, 2024 (S.C. 2024, c. 13). Creates the independent Miscarriage of Justice Review Commission (named David and Joyce Milgaard's Law for the wrongfully convicted Saskatchewan man and his mother who led the advocacy push for over 30 years). Replaces the existing federal ministerial-referral process (in which the Minister of Justice personally reviewed wrongful-conviction applications) with an independent commission with full investigative powers. Implements recommendations from the 2018 LaForme/Westmoreland-Traoré Report on wrongful convictions. Sponsored by David Lametti as Minister of Justice.
