An Act to amend the Interpretation Act and to make related amendments to other Acts
Amends the Interpretation Act to require federal statutes to be read consistently with the Indigenous and Aboriginal rights protected under section 35 of the Constitution Act, 1982. Embeds a uniform non-derogation clause across the federal statute book rather than requiring it to be added bill-by-bill.
Status
Quick learn
Tells courts to read every federal law in a way that doesn't trample Indigenous and treaty rights under section 35 of the Constitution. Replaces the patchwork practice of adding a non-derogation clause to each new bill with a single rule that covers them all.
